Finally coming up on my second disability hearing in August (first filed in 2004.) I also have numerous medical problems, including degenerative disc disease in my neck and back. Any advice? |

I really need some guidance from anyone who has tried to win Social Security disability on SD. My first hearing before a judge contradicted the opinion I could not be expected to perform my previous job. The vocational expert than listed all my previous jobs in significant numbers in Bookkeeping, Accounting, Accounts Payable and Receivable, Billing, Timekeeping and Auditing. I lack the physical ability and in some jobs the skills (like medical coding or a degree in accounting.) I also did these jobs back in the 70's or recently in a small business with a paper and pencil system. I can't spend much time on a computer because of neck pain. I recently had to quit a HR job which turned out to be timekeeping on a paperless system so I was on a computer all day. I also don't know of any job where you do not have to talk to your boss, co-workers, or other customers. That is why I had to quit my part-time Bookkeeping job and two other jobs. All involved talking and working all day on a computer. |

Hi Karen,
I can't give you advice, but I can tell you that I know of one person who got SSDI on appeal, but their doctor had to come forward and state that it was a life impacting disorder. I've also heard about disability cases in general, not specific to SD, and the word is that a good disability lawyer can walk you right through the process. Sorry I can't be of more help.

It is often difficult to prevail in an SSDI case (and particularly so for someone with SD), but it can be done and many of us with a variety of different types of dystonia have succeeded. It is helpful to have a physician detail the impact of your disorder on your daily life so that the SSA will have a better understanding of the disabling aspects of SD and any other medical conditions that you may have that would prevent you from being "substantially employed." I have had cervical dystonia for 33 years and won my case back in 1989 when I appeared before an Admin. Law Judge, mostly thanks to my wonderful SS attorney. He is in San Diego and still representing dystonia-affected persons. I was his first dystonia case but he has really educated himself about the disorder. Thank you very much for the information about the lawyer website. I think that it has been needed to get some reputable information about social security lawyers out to the general public, especially those afflicted with dystonia, and especially SD, since that is what most of the people on the bulletin board have. Another good service is the Lawyer Referral Service, although I'm not sure if they're national, or only here in Texas. Good Luck to anybody that tries to go the SSDI route... Karen, I also lost my SSD case after the first hearing, in 2005. I was advised by my attorney to re-apply when I reached age 60, which I did in 2007. I had my second hearing before the ALJ about two weeks ago, and just got notice that I had been approved. The approval was based on the fact that I am "of advanced age" (ouch!) and also have an arthritis-type condition that would affect my ability to do manual labor. My disability is only retroactive to the time this condition was diagnosed last year--not 7 years ago when I became unable to do my work due to ABSD. I'm sure I would not have won this case had I not had an attorney who specializes in SSD cases. I wish you well. Let me know how your hearing goes. Vici vicif@verizon.net |
